1. Agreement to Terms

By accessing and using the services of HighPoint Digital, you agree to be bound by these Terms of Service and all applicable laws and regulations.

2. Services

HighPoint Digital provides contractor marketing services including but not limited to:

  • SEO for Contractors
  • Google Business Profile Optimization
  • Contractor Website Design
  • Lead Generation (multi-channel SEO + GBP + Ads + LSA + automation)
  • Digital Foreman Automation (Beta)
  • Trade-specific marketing (plumbing, HVAC, roofing, water damage, auto/diesel)

3. Engagement Terms

All marketing services are provided on a month-to-month basis unless explicitly stated otherwise in writing. There are no long-term contract lock-ins. Either party may terminate the engagement with 30 days' written notice.

4. Pricing and Payment

All prices are quoted in USD and are subject to change with 30 days' notice. Monthly service retainers are billed in advance. Website design projects are billed as one-time projects with payment terms confirmed at project kickoff.

5. Service Performance and Guarantees

HighPoint Digital does not guarantee specific search engine rankings or first-page results. Google does not allow ranking guarantees and the algorithm is dynamic. We DO guarantee transparent weekly reporting (rank maps + call tracking), monthly performance reports, and direct access to founder during the engagement.

6. Cancellation Policy

Marketing services may be cancelled at any time with 30 days' written notice. Pre-paid monthly retainers are not refunded for the remainder of the billed month, but no further charges will apply after cancellation.

7. Website Ownership and Transfer

All websites built by HighPoint Digital are owned by the client. Upon cancellation or completion, we transfer all source files, hosting access, domain registrations, and account credentials. We do not retain any control or proprietary lock-in over client websites.

8. Confidentiality

Both parties agree to keep confidential all business information, customer data, and proprietary strategies shared during the engagement.

9. Limitation of Liability

HighPoint Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or any business outcomes related to the services provided.

10. Intellectual Property

All proprietary content on this website is the property of HighPoint Digital and is protected by copyright laws. Client-specific content created during engagements (website copy, marketing materials) is transferred to the client at project completion.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website.

12. Governing Law

These Terms of Service are governed by the laws of the State of Colorado, United States.
